Charry Terms of Use

1. Introduction
These Terms of Use (“Terms”) govern your access to and use of the Charry annetusäpp mobile application (the “App”), operated by MTÜ CharryApp (Registry code: 80656499), a non-profit registered in Estonia. By using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
2. Purpose of the App
Charry annetusäpp provides a platform for donating money to verified Estonian charity organizations. Charry annetusäpp is designed to make giving simple, transparent, and engaging. Users can browse featured Estonian charity organizations, view their descriptions, and select causes to support. The App includes features such as donation tracking, badges and streaks for active donors, and personalized feedback on the donations. Our goal is to encourage kindness and make charitable giving a rewarding everyday experience.
We facilitate the transfer of funds via our payment provider, Maksekeskus AS, who is an authorized personal data processor.
Each charity is solely responsible for the use of funds they receive.
3. Eligibility and User Accounts
You must be at least 13 years old to use the App. Users aged 13 to 17 may use the Service, but we recommend they inform their parents or legal guardians before using the App, especially when making donations or providing personal information. Parents or guardians are encouraged to review these Terms and our Privacy Policy and guide minors in responsible use of the Service.
When creating an account (including social logins via Google or Apple), you must provide accurate information and keep it updated.
You are responsible for maintaining the security of your account credentials.
4. Donations
All donations are voluntary and non-refundable once processed.
Donations are processed in euros (EUR) and transferred directly to the selected charity organization via our payment partner (Maksekeskus AS). Once processed, donations are typically non-refundable, as funds are immediately allocated to the charity and are no longer under our control.
Donation receipts, when applicable, are issued by the charity organization, not by Charry annetusäpp.
We are not responsible for the activities, programs, or outcomes of individual charities. However, we carefully select the organizations featured in the App and take steps according to our selection protocol to ensure that they are trustworthy and legitimate.
5. Revenue Model
When making a donation through the App, donors can optionally choose to cover the transaction fee charged by our payment provider (0.9% of the donation amount + €0.05) and the platform operation fee (2.1% of the donation amount).
If the donor chooses to cover the fee, the full donation amount plus the fee will be charged to them, and 100% of the donation amount will be sent to the selected charity organization.
If the donor does not choose to cover the fee, MTÜ CharryApp will pay the fee from its own funds so that 100% of the donor’s intended donation amount still goes to the charity.
At no point will the transaction fee be deducted from the donation amount.
Additionally, we may generate revenue through other non-intrusive means such as optional tips, corporate sponsorships, charitable events, or optional virtual features. These sources of income are independent of user donations and do not affect the amount sent to the selected charity organization.
6. Acceptable Use and Prohibited Conduct
You agree not to:
Use the App for fraudulent, illegal, or harmful purposes.
Attempt to interfere with the security or functionality of the App.
Misuse personal data of other users or charities.
Upload unlawful or abusive content in any communication within the App.
7. Intellectual Property
All content in the App, including our name, logo, software, and design, is owned by MTÜ CharryApp or licensed to us. Logos and trademarks of partner and charity organizations displayed in the App remain the property of their respective owners and are used with permission. Nothing in these Terms grants you rights to use these third-party logos or trademarks.
8. Third-Party Services and Links
The App may integrate with or provide links to third-party services, such as payment processors (Maksekeskus AS), authentication providers (Google, Apple), analytics tools (Google Analytics for Firebase), and charity organizations’ websites. These third parties operate independently from us and have their own terms and privacy policies.
We do not control and are not responsible for the content, security, practices, or policies of these third-party services. Your interactions with them, including any data you provide, are governed solely by their respective policies. We encourage you to review these policies before engaging with any third-party services through the App.
9. Privacy and Data Protection
We process personal data according to our Privacy Policy, which complies with the EU GDPR and Estonian data protection law.
In addition to processing personal data as described in our Privacy Policy, we may collect and analyze aggregated or anonymized usage data (e.g., donation patterns, demographic trends) to understand how people use the App and to improve our features. This analysis does not identify individual users.
10. Service Availability and Changes
We aim to ensure uninterrupted access to the App but cannot guarantee it. We may update, suspend, or discontinue features or the entire App at any time without prior notice.
11. Liability and Disclaimer
We provide the App “as is.” While we strive to ensure accurate functionality, to the fullest extent permitted by law, MTÜ CharryApp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the App or donations made through the App.
12. Termination
We may suspend or terminate your account if you violate these Terms, our Privacy Policy, or applicable law.
You may terminate your account at any time by deleting it through the App settings or by contacting us at robert@charry.ee. Upon termination, these Terms will continue to apply to any donations made prior to termination.
13. Governing Law and Dispute Resolution
These Terms are governed by Estonian law. Any disputes will be resolved in the courts of Estonia (Tallinn).

We may update these Terms from time to time. Updated versions will be posted within the App and indicated by an updated “Last Updated” date. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
